Background
The Model Penal Code proposes four forms of mental culpability or states of mind purposely, knowingly, recklessly and negligently. In cases where the material element of an offense is not expressly stated and prescribed by the law, then the code is relied upon to determine the level of intent. The four conditions are considered when determining whether they posses culpability with respect to general intent crime. The Model Penal Code goes beyond the general and specific intent to committing a crime by defining the levels of responsibility. To establish criminal liability then the state of mind and the intent are taken into consideration.
Purposely
The notion of purpose is related to the notion that people act intentionally, where the intent of the action is made to achieve a certain purpose especially to cause harm. The defendant then intends or hopes that there will be a specific end result. In other words, acting purposely is the criminal intent that is a deliberate attempt to commit a crime to cause a certain result (Lippman, 2010). For instance, two neighbors have frequent disagreements whereby Jones threatens Pratt his neighbor for months and when one morning Jones stabs Pratt and fails to call an ambulance then the actor had the intent to cause harm to Pratt. The specific intent is to cause harm or kill Jones and the actor’s conduct after the incident show the intended purpose. The defendant can be convicted based on the purposeful specific intent of causing serious bodily harm.
Knowingly
An actor acts knowingly related to an offense, when there is a material element, where the defendant knows the probable consequence of their acts (Kozlov-Davis,, 2001). Knowingly is different from purposely since the defendant is aware that the result is most likely to happen. For instance, a person who tells his friends that firing at a crowd would not injury someone, despite knowingly the danger goes ahead and shoots during rush hour in a subway station and kills an unidentified person. In this case, the actor’s nature of the act is shooting a loaded gun at a crowd, and his attention is to show that no person would be hurt.
