Background information The company determines pay of an individual basis based on an amalgamation of the following  Pay prior to joining the organisation  Performance determined annually based on the income generated by the individual and the use of performance assessment by the manager using the following criteria o Work ethic o Departmental/functional contribution that is then moderated with the use of a bell curve so that a normal distribution of results are provided  A market rate survey for similar roles in the financial sector The company does not publish or does not have a pay policy as such, nor does it monitor individual pay. This company does not publish its performance related pay criteria to the staff This company does not recognize an independent trade union There is a clause in everyone’s contract that it is a disciplinary offence to discuss individual pay with others. 3 Guidance Reading This assignment draws on learning throughout the course and students however some key areas that students might find particularly useful for this exercise are in weeks one, three, five, eight and nine. For an assignment you should consider the following areas of study:  Different pay systems and structures, including fixed and variable pay  The law and theory of equality in pay  EHRC guidance on pay audits Style The paper should be presented in report format with the completed table inserted into your report. Thus it should be presented section by section addressing the particular questions posed numbered one to five. On this occasion references should be submitted as full citations within the footnotes and these do not count towards the overall word count. Remember to take into consideration the background information where it is appropriate to do so. What do we mean by the term “critically examine”? To be critical means that you need to question the information and opinions in the text in an attempt to judge it’s overall worth. It should include an account of the strengths and weaknesses of any proposal- not solely a negative or positive view - and in order to do this think about the following. Most articles will set out their aims and objectives clearly at the outset but make sure that you understand these, check through your lecture notes or the recommended text book to find relevant definitions and or explanations of terms/ theories for which you need further clarification. Think about whether you have understood the concepts /theories? Sometimes in academic articles theories and concepts that are introduced may be new to you particularly when you are new to studying a subject so again check through your lecture notes or the recommended text book to find relevant definitions and or explanations of terms/ theories for which you need further clarification. Remember that we often make assumptions that underlay the concepts and theories we use and the proposals we make. Most research is based on some fundamental assumptions from which new research develops but it is important to understand what assumptions are being relied upon. If these are not clearly specified you should ask yourself what assumptions are being made in the article or paper under consideration, for example if the research is about pay and motivation based on a laboratory experiment on students, does it assert that all individuals in employment 4 will react the same way, that is assuming that everyone is motivated in the same way by additional pay, no matter the culture, age, occupational and existing earnings? A statement can be clear, accurate, precise, and relevant, but superficial (that is, lack depth). For example, the statement "do as I say" which is often used to discourage actions, is clear, accurate, precise, and relevant. Nevertheless, it lacks depth because it treats what might be an extremely complex issue, perhaps the pervasive problem of poor performance, superficially. It fails to deal with the complexities of the issue. So think about what factors make this difficult or complex? What are some of the complexities embedded in this assignment? Which, if any, of the difficulties do you need to deal with? A line of reasoning may be clear, accurate, precise, relevant, and deep, but lack breadth (as in an argument from either the conservative or liberal standpoints which gets deeply into an issue, but only recognizes the insights of one side of the question). Do you need to look at this from another perspective or consider another point of view? Do different elements in the assignment follow logically from one another? Question Two
The Equality Act 2010 requires that employers should offer equal pay to both women and men doing the same job in the same employment job group. Equal pay does not only apply to the salaries but also on terms of employment such as pension contributions, company cars, holiday entitlements, bonuses and other benefits that the company offers to its employees. Therefore, employers are obliged to provide equal pay to their employees. Although the law of equal pay is complicated in its own nature, its purpose is to ensure that women and men doing the same job receive equal and same rewards. The law further states that where there are equal job duties, the sex equality clause should be automatically be included in the contractual agreement of the woman to ensure that she receives her pay and other terms not less favorable than those of the man (Bryant, Winters and Matson, 2015).
Whenever a woman performing the same duties as those of man is getting less pay or other less favorable contractual terms, the employer is required to explain why that is so. If the employer does not explain that the difference in pay is because of a material factor that has nothing with gender, the equality clause will have to take effect.
From our case, the company does not allow the employees to discuss their contractual agreements with anyone; they take it to be a secret between the employer and the employee. It also states that individual pay is determined by the performance of the workers which is not applicable. The company does not have a pay policy which is supposed to guide it on how it pays its employees. From the analysis of the company, there is unequal pay between women and men in the same grades. Men are paid more than their female comparators.
