For this assignment, you will locate a court case involving a food service establishment and an individual becoming ill
after having a meal there. You may use the CSU Online Library to locate a case. Please be sure to reference your
source using APA Style. Once you have read and understand the case, write a three page paper following the
directions below.

The format will be according to APA Style (typed, double-spaced) and in four parts:
1. Part One is a summary. In this segment of the paper, provide an in-depth summary of the court case. Include
what precipitated the case. This summary should be in your own words, using quotes to support what you have
written.
2. Part Two presents the arguments. Here, you should present the arguments made in the case. Essentially, you will
discuss what the attorneys for the plaintiff and the defendant argued for their respective client(s).
3. Part Three presents the outcome/ruling. Discuss the outcome and ruling. You should include the ways the court
used the arguments of the parties to create their ruling, opinion, or verdict.
4. Part Four presents your reaction. You are to provide your reaction (insightful, critical, and logical) to the points
made in the case including the ruling, opinion, or verdict. A simple statement of agreement or disagreement is not
enough. While you may make such a statement by way of introduction to your reaction, you must clearly and logically state the reasons for the position that you have taken.

Food poisoning in restaurants is a common case in the society today. Potential viruses and bacteria are considered to be the major transmitters of such illnesses. When a restaurant, food distributors, or a grocery store face a blame for food poisoning, customers have the right to sue the business and contest their case in a court of law. This paper looks at an instance of food poisoning in a University cafeteria.
Case Description
In a campus, name disclosed, there are two cafeterias managed by a fast food company that holds a food chain. About 5000 students have registered on the campus, with 2000 of them boarding. They use the food facility on the campus for their meals every day. The students dine at the cafeteria that serves a variety of foods.
A hypothesis generating interview taken after ten cases were reported by an emergency Student Health Centre on campus revealed some truth. All of this cases, as purported by the medical doctor, had an onset outbreak on the 10th of March. The students are said to be from different residential apartments on the campus, and all were reported to have been taking their meals at the Universities cafeteria. The students began developing instances of vomiting and diarrhea and were quickly rushed to the health facility around campus. After a diagnosis, it was established that the students were poisoned, with the cause being beef. After treatment, the parents to the affected students sued the food joint, and their case mentioned in court after a week.
Findings that were carried out revealed that the food from the cafeteria was the source of the outbreak. The staffs who were working in the cafeteria were questioned about their responsibilities in the food joint. The staff also were asked if they used gloves, hand washes, and their work schedules to determine the cause of the outbreak. The Chef responsible for the hotel admitted that they had meat in their refrigerator for long, and he suspected this could have been the cause of the outbreak.
Summary and an in-depth Analysis of the Court Case
When the jury took a time to analyze the case, he reached a conclusion when the Chef admitted having stored meat in the refrigerator for a long period. After some food tests, the court was informed that the meat was the cause of the outbreak.
The judge responded by indicating that this was a case of outermost negligence. He said, "Every business has the sole responsibility to exercise reasonable care in maintaining a safe environment, produce safe products and eliminate unreasonable dangers."The judge also added that the restaurant breached its duty to the students by storing food in an unsanitary manner (Berberoğlu, 2012). After the staff members had pleaded not guilty of the results, the case took a different turn. The results determined that the staffs were following orders from their manager.
